76-502. Fast-food restaurants.


(a) 
Permission. Fast-food restaurants may be allowed in the C-3 district.
(b) 
Requirements and conditions. Requirements and conditions shall be as follows:
(1) 
The site and use shall be located on a major or secondary thoroughfare having a right-of-way equal to, or greater than, 120 feet, as specified by the master plan.
(2) 
Freestanding fast-food restaurants, if located on or adjacent to a shopping center site, shall be limited to shopping centers which contain floor area in excess of 100,000 square feet.
(3) 
Adequate ingress and egress to handle the traffic anticipated to be generated by the use shall be provided.
(4) 
Any freestanding fast-food restaurant located in a shopping center shall be aesthetically compatible in design and appearance with the other buildings and uses located in the shopping center. In making this determination, the planning commission shall consider the architectural design of the building, the signage and the landscaping to ensure that the design and appearance of the developed fast-food restaurant site is compatible with the design and appearance of the remainder of the shopping center.
(5) 
Drive-through service shall be permitted only if the fast-food restaurant is located in a freestanding building and a satisfactory traffic pattern for the drive-through lane can be established to prevent traffic congestion and the impairment of vehicular circulation for the remainder of the development. Vehicle stacking lanes shall not cross any maneuvering lanes, drives or sidewalks.
(6) 
Devices and controls adequate to ensure that no smoke, odor or gases are emitted so as to constitute a nuisance to adjoining tenants or to the public shall be provided.
(7) 
Devices for electronically amplified voices or music shall be directed or muffled to prevent any such noises from being audible at any lot line.
(c) 
Environmental provisions and parking requirements. Environmental provisions and parking requirements shall be as required in articles V and VI of this chapter.
