76-524. Refuse disposal incinerators and transfer stations.


(a) 
Permission. Refuse disposal incinerators and transfer stations may be allowed only in the M-2 districts. If the state statute does not preempt local land use regulation as to location and operation of such uses, the following provisions shall apply.
(1) 
The proposed plan of operation shall be approved by the state, the county health department and township engineer.
(2) 
All refuse storage dumping and feeding shall be done within an enclosed structure.
(3) 
All ash and other incineration by-products shall be stored in an enclosed structure.
(4) 
Smokestacks shall be of a design and operated in a manner so as to preclude the emission of noxious odors and smoke which would interfere with the use of adjoining properties.
(5) 
All ingress and egress to incinerators shall be paved roads and driveways maintained in a dust free state.
(b) 
Permit required. If approval for such use is granted by the planning commission, a permit shall be required in accordance with the provisions of this Code.
(c) 
Environmental provisions and parking requirements. Environmental provisions and parking requirements shall be as required in articles V and VI of this chapter.
